General Terms and Conditions (GTC)
Scope of Application
These General Terms and Conditions apply to all contracts regarding digital content and memberships concluded between the Provider and users via the "Wie geht Fahrschule" website.
Provider:
Wie geht Fahrschule?
Fährstraße 217
40221 Düsseldorf
E-mail: info@wiegehtfahrschule.de
Subject Matter of the Contract
Digital learning content regarding driving schools and training measures is provided via the website. This includes, in particular:
Explanations regarding driving schools / driver's license classes
Digital pre-drive check cards
Video explanations
Learning materials and supplementary content
The content is intended to support the learning and understanding of pre-drive checks and does not replace training at a driving school.
Conclusion of Contract
The presentation of services on this website does not constitute a legally binding offer, but rather an invitation to submit a contractual offer.
By clicking the "Buy," "Order," or "Request Access" button, the driving school or company submits a binding offer to conclude a contract.
The contract is concluded upon acceptance by the Provider. Acceptance occurs no later than the activation of the booked access codes or the provision of the agreed services.
Access Codes and Usage Rights
The access codes provided by the Provider are intended exclusively for the agreed number of learner drivers.
Each access code can be redeemed only once and, following initial activation, is permanently assigned to a single learner driver.
Upon activation, the learner driver receives access to the unlocked content for an indefinite period. The Provider is entitled to further develop the platform technically and to update or adjust content. Should the operation of the platform be discontinued in the future, this will be announced with reasonable advance notice. Access codes that have already been purchased or issued cannot be returned, exchanged, or refunded. This also applies to access codes that have not yet been redeemed.
Access codes may only be used for the agreed contractual purpose. Transferring, reproducing, reselling, or otherwise misusing the access codes is prohibited.
The driving school is responsible for the secure storage and issuance of the access codes.
Prices and Payment Processing
Fees are based on the offer individually agreed upon between the provider and the respective driving school or company.
Payment may be made via bank transfer, credit card, or external payment service providers (e.g., PayPal, Stripe, or similar providers). The terms and conditions of the respective payment service providers also apply.
Unless expressly agreed otherwise, all prices are exclusive of applicable statutory VAT.
No Right of Withdrawal
The offers on this platform are directed exclusively at business entities within the meaning of Section 14 of the German Civil Code (BGB)—specifically driving schools, educational institutions, and other commercial clients.
Contracts are not concluded with consumers. Therefore, there is no statutory right of withdrawal.
Liability
The content of the platform is created with the utmost care. However, no guarantee is provided regarding the accuracy, completeness, or currency of the content made available.
The content provided is intended to support driving schools and learner drivers; it does not replace legally mandated training content, official regulations, or official examination requirements.
The provider is liable without limitation in cases of willful misconduct and gross negligence, as well as in accordance with mandatory statutory provisions.
In the event of a breach of essential contractual obligations due to simple negligence, liability is limited to foreseeable damage typical for the contract. Copyright and Usage Rights
All content on the platform—including, in particular, texts, graphics, videos, learning materials, downloads, translations, and other digital content—is protected by copyright.
The purchase of an access code grants solely a non-exclusive, non-transferable, and non-sublicensable right of use within the scope agreed upon in the contract.
Reproduction, publication, making available to the public, disclosure to third parties, modification, or any other use beyond the agreed contractual purpose is prohibited without the provider's prior written consent.
Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Sales Convention (CISG).
The place of jurisdiction for all disputes arising from or in connection with this contractual relationship is Düsseldorf, to the extent permitted by law.
